How to avoid a dispute
Here are some useful tips to help you protect your business from entering into disputes…..
- Make sure your own business details are correct. It sounds obvious, but it can cause problems if they are not absolutely accurate. For example, if you are a limited company, check that ALL your documents – including your cheques – bear the correct company name. If they don't, you could find that the individual, not the company is personally liable.
- Make sure you know who you are dealing with. Again, you may think you know who your customers and supplies are. But experience shows us that in most disputes we work to resolve, clients do not know the correct identity of the people or businesses they are dealing with. A lot of time and money can be wasted trying to find the correct legal entity to pursue or even worse suing the wrong entity.
- Make sure all your dealings are in writing or confirmed in writing. This will protect you, and leave less room for disputes in the future. It's important to remember that, if the worst comes to the worst, the courts usually prefer written evidence over verbal.
- Keep up-to-date notes. Make sure you make and keep notes of all conversations relating to any contract or dispute. These may prove invaluable in the future if you need written evidence to help resolve a problem or disagreement.
